In May 2006, Girard Gibbs filed an amended class action complaint in the United States District Court for the Northern District of California on behalf of all persons in the U.S. who were charged on their bank, home mortgage, or debit accounts for any Trilegiant membership, and on behalf of all California residents who were charged on their credit cards for Trilegiant memberships.

FOR CURRENT CLASS ACTION LAWSUIT INFORMATION AGAINST TRILEGIANT:

Trilegiant Litigation

Trilegiant Corporation (f/k/a Cendant Membership Services, Inc. and CUC International) offers a variety of membership services such as Auto Vantage, Buyers Advantage, CompleteHome, Credit Alert, Digital Protection Plus, Great Fun, Great Options, HealthSaver, Hot-Line, Just for Me, National Card Registry, Netmarket.com, Privacy Guard, Shoppers Advantage, Travel ER, and Travelers Advantage. To market its memberships, Trilegiant generally purchases personal and financial information from a variety of financial institutions and other businesses. After acquiring this information, Trilegiant has charged a number of people's accounts without their knowledge by either "cramming" or through fraudulent "free" trial periods or gifts. The certified class includes all persons and entities who had unsolicited charges for Cendant products posted to their credit card, phone, bank, or mortgage accounts. We are seeking reimbursement for all unauthorized charges received by Trilegiant.

CONSUMER COMPLAINTS

April of Chicago IL (01/03/08)
We are a theater in Chicago, and a customer called to book tickets with a discount he received from Great Fun. I had never heard of this company and asked for a little more information (websites, phone numbers, publisher) from the customer and came up with Trilegiant. Our marketing director had also never heard of either company so I took the customers name and number and told him I would call him back after a little more searching (maybe we had made a mistake). A web search of Great Fun and Trilegiant produced a slew of complaints. I called the company and asked why we were listed in their discount directory? He told me that he had no record of us. I said, I know that, so why are we in your discount book? I asked him if he could grab a hard copy of the book they send out to Illinois customers and tell me if we were listed. He said he didn't have one. Okay, can you log onto your website (we couldn't do it without giving a credit card number, fat chance!) and tell me if we were listed there?

He tranfered me to Lee who informed me that he was a supervisor. I asked Lee all of the same questions. He told me that this was a corporate issue (whatever that means) and he would have to transfer me. I said, But you're a supervisor, and I have very simple questions that a supervisor should be able to handle. He responded by saying that there was a lot of static on the line and he was having trouble hearing me. After he made me repeat myself several times I gave in and let him transfer me to corporate. That office was closed at 4:30 pm CT time with no voicemail. I will be talking to Lee again and filing a complaint with the BBB. I have informed the customer who first told us of Great Fun and encouraged them to do the same.

As of today, this is the first we've heard of Great Fun or Trilegiant, but we are appalled that they are using our name without our permission, and that unsuspecting consumers might associate us with them.

I received a $9.25 check with the Chase logo on it, if cashed, would have enrolled automatically in SecureAll unless I called a number to cancel. If Chase and Trilegiant settled a class action suit, paid damages and agreed to reform their marketing practices, why are they still doing exactly the same thing?

Glenn of Thomaston ME (12/22/07)
Elite Excursions (aka Trilegiant) sent me a membership packet explaining my benefits and thanking me for purchasing their services. I'd never heard of these people and had no idea how they got
my credit card info. I quickly found they were a fraudulent company and called to cancel membership I'd never solicited. The rep at Elite told me that I'd cashed some sort of promotional check issued by Chase Bank. I was outraged and as quickly as my anger boiled, the Elite rep launched another sales pitch, and I hung-up on her.

I've had to cancel all of my accounts and take time out to reinstall accounts for all of my on-line accounts due to Trilegiant's fraud.

Trilegiant is charging me $11.99 every month from my credit card without my knowledge. It is using my
credit card information fraudulantly. It has deducted $11.99 last month and this month and made me suffer and wasted my time as I am confused as to who this Trilegiant is deducting from my credit card without my knowledge. They might have stolen my credit card information from somewhere and are using that information to cheat people like me. Please take certain action on this company so that it may not cheat others and me in the future.

John of Denver CO (12/18/07)
This is the second time I got a charge from whomever this company is. The first time it caused charges for overdrafts on my account and I sent my bank, Wachovia (which in itself is a piece of work) to block it. But the Wachovia Bank insisted to let them charge me another 36 dollars after I disputed the first charge from Great Fun. So Wachovia is getting something for this (for them charging overdrafts from hidden charges coming from no telling where).

Overdafts on account and many hardships.

Donna of Brunswick, GA (12/17/07)
In the spring of 2006 I made reservations at a Roadway Inn in Orlando FL. While making the reservation, someone from Travelers Advantage asked me about a trail membership. They said they would send gas vouchers for us to use on the trip. We canceled the trip, so we did not use the vouchers.

We thought that was the end of that matter until we noticed money being taken from my credit card. We called and had the charge removed and told them we did not want their services. We did not hear from them any more.

In September of 2007, we deposited $200 into a
new credit card. When we tried to use that card to rent a car, we found the money was not there. On my credit card statement for Oct. 2007, we found $119.99 billed by Tlg*Trvel ADV. How did this company get money from this new credit card without the new credit card company's help?

  • Jacek Says:

I recently had 4 x 25 USD charges made to TWX*IIA AIM CALL OUT888-265-9269 . Then one charge 129.95USD to Academic Super Store Austin. Seems like they were trying my card first.

  • Robin Says:

I just discovered a $25 charge from TWX*IIA AIM CALL OUT888-265-9269 dated December 25, 2007. Jacek, have you had any luck figuring out what that is?

  • Robin Says:

I called 888-265-9269 (AOL) and finally navigated the automated “operator”, which was difficult since I do not have an account with AOL, to talk to a live person. He asked for my credit card number, and I told him I did not want to give it to him. He said that if I was worried about the security of my credit card information, not to worry, they would protect it. As I started to explain that since I had gotten the phone number off of my credit card in relation to what I believed was a fraudulent charge, I was not going to give my credit card number, he hung up on me! I immediately contacted my credit card company, and they recommended that rather than just dispute the charge, I should flag it as a fraud case, which I did.

  • David Says:

I just had 4 charges at $25.00 each on my bank account. 2 for yahoo voice and 2 for twx. I have no idea how they got there and it is right before Christmas when I really needed the money. I contacted the yahoo number and they ask for alot of information, birthdates, zip codes, card number, they sound like someone taking my personal information and will scam me more, but said they would elimintate the charges Found out about TWX from this website and called them and finally got a representative and she said they do not show me having an account but would forward the information to their customer service. Cancelled my atm card and will try to pursue further. This really caused a burden on me as I have low income and two children to try to buy Christmas for, now I have even less money to do so. I am considering canceling any and all electronic ordering of anything. I wonder if netflix is part of the culprit, I’m probably going to cancel them too, because their name has come up here. In fact anyone I see in this blog I will try not to do business with and will try to follow up with the Attorney General etc. Thanks for the info, I would not have had a clue otherwise.

  • charity Says:

I just had 2 suspicious authorization charges on my paypal debit card. They were for $1 each. This is to notify you that a payment of $1.00 USD was made to TWX*AOL VIDEO 888-265-9269 VA using your PayPal ATM/Debit Card. I have never given AOL my debit card information. I called and instantly had my card cancelled and am having a new number and card issued. I have put my netflix on hold and after reading this blog I will probably be cancelling my netflix. Because if this is where that company got my information I don’t need to watch videos that much. I found this blog via looking for information on this. I will be calling my attorney generals office and filing complaints against this company.

  • NickyV Says:

    Hi,

I started getting charges a few days ago after filling out one of those websites where you look at adds, consider them and you can get a free xbox 360 .The sad thing is where i got the website from was my fav magazine Gamepro. The only thing I did buy was a subscription to gamefly. the charges I did not make where TLG shoppe, TXW and a few other charges from places i never heard of. this is ***** and someone needs to do something about it. We need to ban together and put a stop to it.

  • Anne Marie Says:

If this blog of complaints against TLG was started in Jan 25 2005 and there have been people complaining since 2003 and this is now Nov 29 2007, why is TLG still out there?

I have found 22 sites in the last hour (since I got off the phone w/ my CC company) where people have leveled complaints against TLG’s different divisions and 9 sites where people are happy they exist. There has to be something more we can do to rid ourselves & others of the continuing potential scams run by this company.

  • Bruce Says:

The scam continues: I found monthly charges for $11.00 on my Bank of America Master Card from TLG*TRVLADV this month and last month. I have no idea how these TLG*TRVLADV people got my card number. I first called the bank and complained. They said I had to get the “merchant” to reverse the charges and told me to call 800-318-2709. I did a web search on the number and found this blog. I then called the bank again on their lost/stolen card number. I told the bank that my card was compromised and had unauthorized charges. I requested the bank to cancel my card and to credit me for the unauthorized charges. The bank said that they would issue me a new card and give me credit for the unauthorized charges. If they don’t do this, I’ll be back!

  • Lobin Says:

I also received the 11.99 TLG*COMPHME. Anyone could tell me which number to call to cancel it?

  • Pam Says:

I have been mud wrestling with TLG Travelers Advantage and Bank of America Visa for two days over a charge of $119.99 on my statement. It is removed now. Please be aware TLG Travelers Advantage could not find me in their data base by name and address but insisted that I must have purchased a membership from them. They wanted me to give them my credit card number in order to locate me in their system. I didn’t provide it.
Today TLG wanted me to provide the alleged membership number on my billing statement. I instructed the B of A rep on the conference call with us not to give it to TLG. My position is that if TLG did not have my name and address in their system the only way they could get my credit card number was from B of A. I have never responded to any of the offers, rebates etc. referred to as ‘negative options’ through any entity. I have sent a complaint to the Florida AG office that this appears to be collusion such as that between Chase and Triliegent recently settled in California. Don’t be anxious to provide these vendors the info they ask for as it appears to be a ploy to draw out more info from you, then cross reference codes with the Visa company to justify their charges. Instead, dispute it through the credit card company who is, unfortunately, financially in bed with these sleazy vendors. Watch out for check counterfeiting. I just went through that. B of A allowed four checks against my account that had an entirely different name, address, sex and signature. If you need more on this I will explain further. BTW, I am shopping for a new bank to do business with. Any suggestions?
